A valuable file does not become a trade secret merely because a business calls it confidential. The information, its economic value, and the steps taken to keep it secret all matter. Jayakumar Law handles disputes involving alleged use or disclosure of confidential business information, including claims arising after an employee departure or a failed commercial relationship.
The analysis starts with precision. Was the information a customer list, pricing method, process, source material, or something else? Who could access it? What agreements, permissions, and security practices were in place? A clear account of the information at issue helps separate a protectable secret from general knowledge, skill, or information already available elsewhere.
We examine access records, devices, communications, employment documents, and the sequence of events around the alleged transfer or use. In a defense, the same evidence may show independent development, authorized access, or a claim that is broader than the facts. Where immediate relief is sought, the early record is especially important.
Federal and state trade-secret law may provide claims and remedies depending on the circumstances. We assess whether court action, a negotiated return or restriction, or another resolution will best address the client’s concern. We also plan for the confidentiality of sensitive material during the dispute itself; a lawsuit should not unnecessarily expose the information it is meant to protect.
