Trademarks

A trademark is a word, phrase, symbol, or design that identifies and distinguishes the source of goods or services. It represents your brand in the marketplace and protects against consumer confusion. Trademark rights can arise through use, but federal registration strengthens those rights and offers broader protection.

Registration and USPTO Proceedings

We guide clients through the full trademark registration process with the U.S. Patent and Trademark Office (USPTO). This includes preparing and filing the application, responding to Office Actions from USPTO examiners, and representing clients in proceedings before the Trademark Trial and Appeal Board (TTAB), such as oppositions or appeals. These stages often require legal argument and evidence to overcome refusals or third-party challenges.

Licensing, Assignments, and Brand Transactions

Beyond registration, we assist clients with trademark licensing agreements, which allow others to use a brand under controlled conditions. We also draft and negotiate trademark assignments and purchase agreements – whether as part of a business transaction or a standalone transfer – to ensure legal ownership is properly transferred and recorded.

Enforcement and Litigation

We support clients in enforcing their trademarks against infringing parties and unauthorized users, often starting with cease and desist letters and escalating to formal legal action if necessary. When disputes arise, our firm primarily represents businesses on the defense side of trademark litigation – protecting their right to use their mark, challenging overreaching claims, and navigating complex legal standards like likelihood of confusion, descriptiveness, or fair use.

Delivering strong, dependable legal solutions for every client.
